Terms and Conditions

The Terms and Conditions of this website are subject to change. Please check this page when placing each order to ensure you agree with the latest version.

Payment Details

Payment is made prior to the shipment of goods, either electronically or by direct bank deposit. This is one of the ways Ozzy Educational Toys Pty Ltd is able to keep costs down and offer such competitive pricing. Our preference for electronic payments means that no surcharge shall be charged for any payments.

Payment can be made by two common methods:-

  1. Paypal. No surcharge will be charged.
  2. Credit Card (Visa, Mastercard or AMEX).
  3. Direct bank deposit.

Direct Bank Deposit - Payments can be made by Electornic Funds Transfer (EFT) or direct bank deposit.

When depositing funds, please include the order number given during the order process ( also included on your invoice).
YOUR INVOICE wil be emailed within 24 hours of placing your order. This will include a discription of goods purchased and a reminder of our banking account details.

Goods will be shipped within 48 hours of receipt of payment.

Receipt for payments

A full receipt shall be emailed within 1 business day of payment..

Shipment of orders

Your order shall be shipped within 2 business days of receipt of payment. An email notification (including tracking number.) shall be sent once goods are shipped.

All shipping is free of charge for orders above $250 (excluding GST). Their is a flat surcharge of $8 for orders less than $250.

We shall use a recognised courier requiring signature for all shipped goods.

Out-of-stock Items

Our policy is to remove items from our website that are out of stock. This means all items advertised should be ready for shipping. Unfortunately, on rare occasions multiple orders may be received for an item at the same time and some products may be temporarily out of stock. If this is the case someone from our office will contact you to inform you of the situation before your order is shipped. You will be informed of a restock date and will be given the choice of a refund for the item or having the item placed on back order.

You will be notified by email. If no email reply/response within 24 hours we will attempt to contact you by phone. If we are unable to contact you by phone within 24 hours we will send the order without the out-of-stock item and send a credit note (valid for 12 months) for the item which is out of stock. At any time within the next 30 days from receipt of such credit note you can contact us and we will arrange a full refund for that item.

Prices

We guarantee you will never be charged more than the advertised price. Please note that all prices are in Australian dollars.

Damages and Claims

If goods are received damaged or short supplied customers are entitled to receive a replacement or refund (at the buyers discretion). Notification must be made to our office at admin@ozzytoys.com.au or by telephone on (07) 3205 5758 within 7 days of receipt of goods. Failure to advise us within 7 days may result in your request being declined. When your refund is approved we will issue you with a Goods Return Number (GRN) and provide you with details of how to return the goods. If goods are returned before a GRN is issued you will be charged the cost of the freight. Approved returned goods must be received in the original packaging and condition in which they were delivered to you, for a refund to be issued. All refunds will be paid within 7 days of receipt of returned goods.

GST

Ozzy Educational Toys Pty Ltd is registered for GST. All orders shall be issued an invoice which outlines the GST component. Child care facilities, kindergartens and other educational institutions should receive a 100% refund of any GST paid when they lodge their GST returns.

Product Warranty

Ozzy Educational Toys offers a 12 month warranty on all its products. Goods must have been be used in a manner that they were designed for AND by the age group that they were designed for. Ozzy Educational Toys will offer suggestions for age suitability but the final choice is the supervising adults. Proof of a faulty item may require photographic evidence, or if we request, returning the item (at our expense once approval has been given – Refer damages and claims section).

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. You may also be entitled to remedies that cannot be excluded under the Australian Consumer Law if any services supplied by us fail to meet a consumer guarantee under the Australian Consumer Law.

Without excluding, restricting or modifying the rights and remedies to which you may be entitles under the consumer guarantees provisions of the Australian Consumer law or our liabilities under those provisions:

  • You acknowledge that we do not make any warranty or representation as to the suitability of Products for any purpose;
  • We exclude all other implied terms and warranties, whether statutory or otherwise, relating to the Products; and
  • We will not be liable to you for indirect and/or consequential loss arising from or connected to this agreement in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind) unless such loss arises as a result of our own negligence or wilful misconduct.
  • Our liability to you for loss or damage of any kind arising out of this agreement or in connections with the relationship established by it is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability if in contract, tort (including negligence), under any statue or otherwise.
